The Electronic Commerce Act provides for the mandatory content elements of the website imprint since 2008, which has been further expanded since 1 January 2014. Based on this, the following data must be displayed on the website or in the webstore directly and continuously, easily accessible.
If any of the above mandatory elements of the imprint are missing, the consumer protection authority may initiate proceedings and, where appropriate, impose a consumer protection fine on the operator of the website or online store, which may range from HUF 15,000 to HUF 500 million, depending on the type of business. |
Facebook, Google or other social media
It is worth looking at the ratings and opinions on the Facebook page of the company, and you can find these information on Google (Italia Bútor in Google’s system) as well.
It is worth looking for the company’s Facebook page (in our case: www.facebook.com/italiabutor), because there you can see the rating and opinion of customers of the service. The more positive reviews your company has received, the more confident you can be in making the right choice.
You can do the same in a search engine (e.g. google.com) if you type the name of the company. Among the opinions and ratings here you can find the address, contact details and opening hours of the company.
On these pages, ratings range from 1 to 5, with 1 being the weakest and 5 being the best.
It is also important to see if the company responds to negative reviews and whether those negative reviews can be real, as there are people whose opinions are better ignored.

E-report
Here you can find whether the company really exists and it complies with its legal obligation to submit its annual report each year, which presents to stakeholders (owners, investors, creditors) the financial position and profitability of a company at the end of a given business year. The annual report must be deposited in the court of registration, and its content is public.
According to the Hungarian Accounting Law, the content of the annual report is:

Blacklist of infringing webshops
Since 2017, the rule has been in place that the consumer protection authority publishes a list of serious infringement online shops. In 2019, a quarter more online stores committed a misdemeanor than a year earlier. Serious misdemeanors are listed in a government decree (No. 453/2016).
The webstores that make serious misdemeanors, for the first time are only obliged to correct the error, but for the second time a fine may be imposed, which cannot be less than HUF 200,000. At the time of this blogpost there are 37 fined webstores on the list.

Purchase documents (VERY IMPORTANT!!!)
The customer MUST receive a written Order Confirmation immediately after the order, which is the first document of the purchase. It is also IMPORTANT that we receive an invoice for the down payment and then for the purchase.
The obligation to provide invoices and receipts not only serves tax law aspects, but is also of special importance in the field of consumer protection. The invoice is a contract between the consumer and the business concerned, which indicates that a sale has taken place and the exact amount transferred to the other party.
On the other hand, if there is no invoice receipt for the given purchase, or consumers go into not asking for an invoice because it is cheaper, it is better to know that they will not be able to prove their truth (or only with great difficulty) in the event of any subsequent consumer protection problems. Moreover, neither the fact that they have ever been in contact with the business, since in the absence of paper, only the oral submissions of the two parties to the dispute are opposed to each other.
